Tripnary Privacy Policy

Effective date: November 20, 2014.

The term “Tripnary,” “we,” and “us” includes Tripnary, LLC. The Privacy Policy explains how Tripnary may collect, use, and disclose information it obtains through the Tripnary Service.

The “Tripnary Service” is defined as any website, mobile application, or Internet service under the control of Tripnary, LLC, in connection with providing an online platform for Tripnary’s services.

Policy Scope. This Privacy Policy covers how Tripnary treats personal information (“Personal Information”) and other information that Tripnary collects when you are using or accessing the Tripnary Service.

Personal Information. Tripnary considers “Personal Information” to include information that alone or when in combination with other information may be used to readily identify, contact, or locate you, such as: name, address, email address, location, or phone number. Tripnary does not consider Personal Information to include information that has been anonymized so that it does not allow a third party to easily identify a specific individual.

Use and Acceptance. By using this website or the Tripnary Service and accepting the Terms of Use, you also agree to this Privacy Policy. If you do not accept this Privacy Policy, you must not use this website or the Tripnary Service.

New Uses of Personal Information and Other Information. From time to time, Tripnary may use Personal Information for new, unanticipated uses not previously disclosed in our Privacy Policy. If our information practices change regarding information previously collected, Tripnary will make reasonable efforts to provide notice and obtain consent to any such uses as may be required by law.

Posting of Revised Privacy Policy. Our privacy policy may change from time to time. If we make any material changes to our policies, we will place a prominent notice on our website or Tripnary Service. If the change materially affects registered users, we will send a notice to you by email.

Other Websites and Services. When you navigate away from the Tripnary Service to websites or apps controlled by third parties that we do not own or control (“Third Party Services”), you leave the Tripnary Service, at which point this Privacy Policy no longer applies. While we attempt to facilitate access only to those Third Party Services that share our respect for your privacy, we cannot take responsibility for the content or privacy policies of those Third Party Services. We encourage you to carefully review the privacy policies of any Third Party Services you access. You will not receive a notice or warning when you leave the Tripnary Service to access Third Party Services.

The Tripnary Service Collects Your Information

Personal Information Collection. You may use parts of the Tripnary Service without creating an account. However, to save information or to interact with other users on the Tripnary Service, you must register and create an account. To register, you will need to provide Personal Information, such as your name, username, password, email address, location and phone number. With your permission, we may also access other personal information on your device, such as your contacts, or messages, in order to send messages and provide the Tripnary Service to you. Tripnary Service does not retain this information.

You may also register by using your log-in credentials from social networking websites or connect your Tripnary Service account with such websites, including Facebook. When you register in this way, we may collect Personal Information from the social networking websites. For example, when you log in with your Facebook credentials, we collect the Personal Information you have made publicly available in Facebook, such as your name and profile picture. We may also obtain other information with your permission, such as your current city, hometown, and friend list. The information the Tripnary Service obtains may depend on your privacy settings with the social networking website.

The Tripnary Service may associate this personal information with your activities in the course of providing service to you (such as pages you view or things you click on or search for).

Cookies and Automatic Data Collection. In addition, the Tripnary Service collects and stores information that is generated automatically as you use the Tripnary Service, including anonymous usage statistics. We use technologies like cookies (small text files that we place in visitors’ computer browsers to store their preferences), web beacons, or unique device identifiers to identify your computer or device so we can deliver a better experience. Our systems also log information like your browser, operating system and IP address. Our cookies do not, by themselves, contain Personal Information, and we do not combine the general information collected through cookies with other Personal Information to tell us who you are. As noted, however, we do use cookies to identify that your browser has accessed aspects of the Tripnary Service and may associate that information with your account if you have one. Most browsers allow you to block and delete cookies. However, if you do that, the Tripnary Service may not work properly.

This Privacy Policy covers our use of cookies only and does not cover the use of cookies by other Third Party Services. We do not control when or how Third Party Services place cookies on your computer. For example, Third Party Services to which a link points may set cookies on your computer browser.

By using the Tripnary Service, you are authorizing Tripnary to gather, parse, and retain data related to the provision of the Tripnary Service.

Public Information. Some of your activity on and through the Tripnary Service is public by default. This may include, but is not limited to, content you have posted publicly on the Tripnary Service. Registered users may have some of this information associated with their accounts. Unregistered users will not have this association, but information concerning their use of the Tripnary Service (such as what pages they have visited) may be tracked anonymously through the use of cookies and stored by us.

If you choose to provide Personal Information using certain public features of the Tripnary Service, then that information may be publicly available. Individuals reading such information may use or disclose it to other individuals or entities without our control and without your knowledge, and search engines may index that information. We encourage you to think carefully about including any specific information you may deem private in content that you create or information that you submit through the Tripnary Service.

Children’s Privacy. Tripnary does not knowingly contact, collect, maintain, or use any Personal Information from children under 13 years of age. No part of the Tripnary Service is directed to persons under the age of 13. In fact, you must be at least 13 years of age to set up an account with the Tripnary Service. IF YOU ARE UNDER 13 YEARS OF AGE, PLEASE DO NOT USE OR ACCESS the Tripnary Service AT ANY TIME OR IN ANY MANNER.

If we become aware that we have collected any Personal Information from children under 13, we will promptly delete such information from our databases. If you are a parent or guardian and discover that your child under the age of 13 has obtained a Tripnary Service account, please contact us at [email protected] so we can promptly obtain parental consent or remove the child’s Personal Information from Tripnary Service.

How Tripnary Uses Your Information

Internal and Service-Related Usage. Tripnary uses Personal Information for internal and service-related purposes only and may provide it to Third Party Services to allow Tripnary to facilitate the Tripnary Service. For example, users of the Tripnary Service may view your profile along with the content you publish, or the Tripnary Service may display your Personal Information when you contact other Users using the Tripnary Service.

Marketing. Tripnary does not rent or sell your Personal Information with Third Party Services for their direct marketing purposes (without your permission). Tripnary may allow access to other data collected by the Tripnary Service to enable the delivery of online advertising on the Tripnary Service or other Third Party Services, direct marketing and offers, or otherwise facilitate transmittal of information that may be useful, relevant, valuable or otherwise of interest to you.

Other Service-Related Usage. We may collect and retain any Personal Information you provide to:

    Personalize and operate the Tripnary Service;

    Provide customer support;

    Track the types of questions we receive;

    Analyze trends;

    Track user movement;

    Personalize your experience; and

    Otherwise improve and enhance the Tripnary Service.

Aggregate Data. Tripnary may anonymize and aggregate data, such as demographic information, collected through the Tripnary Service and use it for any purpose, but not in a manner that would identify you personally.

Location Data. To customize the Tripnary Service for you, we may collect, use, and share precise location data, including the real-time geographic location of your computer or device. This location data (e.g., latitude and longitude) is collected anonymously in a form that does not personally identify you and is used only to provide and improve the Tripnary Service and customize the Tripnary Service experience to your current location.

This information is NOT shared with others. We may obtain your consent on your first use of the Tripnary Service. Your location data may be sent to us when you install the Tripnary Service and each time you use the Tripnary Service. We use various technologies to determine location, such as location services of the applicable operating system or browser and sensor data from your device that may, for example, provide information on nearby Wi-Fi access points and cell towers, so that we may send you push notifications. The Tripnary Service may use your browser’s or device’s ‘background location’ to provide the Tripnary Service, including, but not limited to sending you push notifications. If you choose to change your privacy settings, your location may be sent to us automatically, from time to time, even if you are not directly interacting with the Tripnary Service and whilst the Tripnary Service is not operating on your browser or device.

Email Communications. We may send email to the email address you provide to us to verify your account and for informational and operational purposes, such as billing, account management, password recovery, or system maintenance. We may also send you email newsletters, or other news about current or future Tripnary offerings. If you do not want to receive such communications, please contact us at [email protected]. We may receive a confirmation when you open an email from us. We use this confirmation to improve our customer service.

User Profile Information. User profile information you enter may be displayed to other users to facilitate user interaction within the Tripnary Service. We will not directly reveal your email addresses to other users.

Tripnary May Disclose Your Information

Vendors and Suppliers. Tripnary may share any information it receives with vendors and service providers retained in connection with the provision of the Tripnary Service. Their use of information is limited to these purposes, and subject to agreements that require them to keep the information confidential. Our vendors provide assurance that they take reasonable steps to safeguard the data they hold on our behalf, although data security cannot be guaranteed.

Sharing. We may share Personal Information about you, such as your name, if you use the Tripnary Service to share articles with your contacts or friends through text message, email, social networking services, or other electronic means of communication. The Tripnary Service will share this information only with your selected friends; however, your friends could share this information with others outside of Tripnary’s control.

As Required By Law and Similar Disclosures. We may access, preserve, and disclose your Personal Information, other account information, and content if it believes doing so is required by law or if those actions are reasonably necessary to:

    comply with legal process, such as a court order or subpoena;

    enforce this Privacy Policy or Tripnary’s Terms of Use;

    respond to claims that any content violates the rights of Third Party Services;

    respond to your requests for customer service;

    respond to law enforcement;

    investigate and prevent unauthorized transactions or other illegal activities; or

    protect our or others’ rights, property, or personal safety.

Merger, Sale, or Other Asset Transfers. Information about you in Tripnary’s possession may be disclosed as part of a merger, acquisition, financing due diligence, sale of company assets, or transition of service to another provider, as well as in the unlikely event of insolvency, bankruptcy, or receivership in which your Personal Information would be transferred as one of the business assets of the company. Tripnary does not guarantee that any entity receiving such information in connection with one of these transactions will comply with all terms of this Privacy Policy.

Tripnary may also disclose your Personal Information with your permission.

Security of Your Information

We reasonable take steps to secure your Personal Information against unauthorized access or disclosure and that your Personal Information is treated in accordance with this Privacy Policy. However, no security or encryption method can be guaranteed to protect information from hackers or human error. Unfortunately, Tripnary cannot ensure or warrant the security of any information you transmit through the Tripnary Service, and you do so at your own risk. Tripnary does not accept liability for unintentional disclosure.

Information we collect may be stored or processed on computers located in any country where we do business.

International Users

By choosing to visit the Tripnary Service or otherwise provide information to Tripnary, you agree that any dispute over privacy or the terms contained in this Privacy Policy will be governed by the law of the state of Illinois and the adjudication of any disputes arising in connection with Tripnary or the Tripnary Service will be in accordance with the Terms of Use.

If you are visiting from the European Union or other regions with laws governing data collection and use, please note that you are agreeing to the transfer of your Personal Information to the United States to us. By providing your Personal Information you consent to any transfer and processing in accordance with this Policy.

Access, Update, or Delete Your Information

Access Your Information. You can sign into your account to see any information associated you’re your account.

Update Your Information. If you would like to update or correct any information that you have provided to Tripnary through your use of the Tripnary Service, please contact us at [email protected].

Delete Your Information. If you would like to delete any information that you have provided to Tripnary through your use of the Tripnary Service, please contact us at [email protected]. We remove personally identifiable information (such as your name, address, email, location or phone number) and other preferences associated with your account promptly after you delete your account. We may retain other data indefinitely. Additionally, given the nature of sharing on the Tripnary Service, any public activity on your account prior to deletion will remain stored on our servers and will remain accessible to the public.

Do Not Track. Currently, Tripnary does not respect browser Do Not Track signals.

California Resident Disclosure Requests. California residents who have done business with Tripnary may request a list of entities with whom we have shared your Personal Information for that entity’s own direct marketing purposes. You may submit your request to [email protected] or by mail to Tripnary, 233 E Wacker Dr, Ste 3107, Chicago, IL 60601. We will respond within 30 days, and will provide a list of the types of information disclosed and the names and addresses of the recipients of that information. Please note, we are only required to respond to such requests once per year.
